Claim of Private or Non-Commissioned Officer for Pay for the Use and Risk of Horse

State of Tennessee, County of Monroe. On this ____ day of ___ 1881 before me Justice of the Peace in and for the County and State above named, personally appeared Richard Arden aged 45 years, who being first duly sworn according to law, declares that his residence and post office address is Madisonville in the State of Tennessee and that he is the identical Richard Arden who was a Private of Company AD@ commanded by Capt.Wm. B. Milligan in the 3d Regiment of Tenn Mt Vounteer Infty. That he volunteered at Loudon Tenn on or about the 25th day of July 1864, for the term of 100 days and was honorably discharged at Knoxville Tenn on or about the 30th day of November 1864 by reason of expiration of term of service . . . That said horse was his own private property, that he continued mounted upon said private horse, and continued to use him in the service until the 30th day of Nov 1864 when he was discharged as aforesaid.. .. He now claims pay at the then legal rates for the use and risk of said private horse from the 25 day of July 1864 when he entered the service, to the 30th day of Novembr 1864 when said horse was taken out of service by Claimant. . . .He makes this declaration for the purpose of obtaining arrears of pay for the use and risk of said horse for the time aforesaid and he hereby constitutes and appoints L. [notes on scrap of paper] Geo W. Carney, Prospect McMinn Co. Proof only partially made. The case is a good one and only requires attention to be successful. Carney is a fair man, at least he presents that appearance from his conversation, and it is understood that he will suply pay for all that is done for him. David M. Lewis knew him for years before the war and had the appearance of a stout able bodied man and had such appearance at his enlistment. Lives within 2 miles at present and been his near neighbor ever since the war; and his general appearance since and that before the war has been quite different, showing signs before of being able &c, and since of being disabled complaining the [torn]

Claimant Carney States: Nov 18, 1881

41 years of age. Resided 5 yrs prior to enlistment in the 13 Civil Dist McMinn Co. Occupation farmer. Since discharge in June 1865 has resided in same place.

Incurred disability in following manner. Was on board Sultana morning 28th Spr 1865. At time of explosion was lying asleep on the upper deck: was awakened by report of explosion & being in a dazed condition stepped off the edge of said deck & in falling struck his hip on edge of middle deck by which received injury. Managed to get hold of a plank & floated distance of some 8 miles. Was rescued by a passing boat & landed at Memphis. After landing was taken to Washington hospital at said place where he stayed about 36 hours - from thence to soldiers home in said city where he stayed 3 days - thence to Camp Chase Ohio stayed about 3 weeks when he was ordered to Nashville for muster out. Thence returned to his home. From time injury received to muster out altho lame did not aply for and received no treatment. Did not apply for [illegible] of being sent to hospital. During that period treated his own case with linement from which he received no benefits. After his return home continued to treat with linaments not feeling able to employ a physician. Has stated his case to Dr. J. L. Leonard & Dr. E. Daniels since war who told him they could afford no relief. That about 1 month ago was examined by Dr. J. E. Jerrill at Queen McMinn Co. who also stated he could not cure said hip. Has not been able to perform more that half the labor of an ordinary farm hand. I F. M. Jack of the County McMinn and the state of Tennessee hav bin pursonly acquainted with George W. Carney for 25 years and was musterd into U. S. Armey the same day and into same regt . . and (Co) an to the best of my knolledg he was a Sound able boded man to which he made a good and faithful Soldir for about 17 months to the best of my knolledg he never was on the Sick list at any time during his Servis and Said time he was captured and lay in Calabba prison sea for about 6 months then returned to Vicksburg Miss for exchainge then on his way North on board the Steamer Sultana She blew up and a totle reck isued to which the said George W. Carney states that he resived and injury by a fall in his left hip which he says has grone worse ever cince which ceeps him from doing manuel labor to which I beleav to be correct for in conversations with him at difirnt times he has complaind to me of his hip to which I believ his statement to be correct and true as I never heard him complain before to which this is my affadavid under oath sworn to and subscribed befor me this the 18 day of November 1881. John B. Hamilton, aged 47 years, member Co. H 3rd Cavy with claimant Geo W. Carney resides in 6th civil District McMinn Co. Was on Sultana with Carney - Saw him after got to land next day at Memphis - went to Hospital at Memphis and remained but short time. Afterwards but short time command was in Nashville for the purpose of being mustered out. While waiting to be discharged affiant procured a private house for Carney to stop at - being in bad health and complaining of being injured. Remained there until discharged ___ several days - Saw him afterwards and knew him all the time and been complaining of receiving injuries on Sultana - hip. Is disabled from manual labor - was stout and healthy when enlisted - knew him before and during the war.

State of Tenn McMinn County. Personally appeared before me R. A. Ellis Clerk of the County Court of McMinn County, James H. Knight and being duly sworn says that he was Captain of company C 2d Regt Tenn cavalry, vols. Who further says that he was personally acquainted with Geo. W. Carney a private in Co. (K) 3rd Tenn Cav. Vols. That he was Sound and able Boddied before he Enlisted and while in the Service untill the Explosion of the Sultana near Memphis on the morning of the 28th April 1865 and that the said Carney received a Severe injury in the left hip by said Explosion. He also further says that he is still acquainted with the said Carney and has been ever since up to this time and that he has been complaining of the injury Ever Since. J. (X) Knight. Attest M. L. Sir: You are hereby notified that a certificate No. 263069 for Original pension, has this day been issued in favor of George W. Carney whose P. O. Address is Mecca, County of McMinn State of Tenn, and that said certificate will be sent to the Pension Agent of Knoxville who will forward it . . . Dear Sir: Yours of the 30 Ult at hand. If you can secure the affidavits of officers or comerads proving that Joseph Devine was killed while in line of duty I can have the claim reconsidered, but before I can do so it will be necessary to send certificate of the death of Mrs. Devine and that her children are the rightful heir. Also have them fill out the enclosed contracts and return to me when properly executed. They were minors at the time the pension was stopped otherwise nothing can be done. Yours truly T. W. Declaration for the increase of an invalid pension

State of Tennessee .. . 1869 . . . John B. Hamilton aged 55 of Nonaburg, McMinn Co., TN . . . declares that he is a pensioner of the United States duly entitled at the Knox___ Tenn Pension Agency at the rate of $4.00 per month . . by reason of disability from Rheumatism . . . incurred in the Military service of the United States while serving as a Farrier in Co. AF@ 3d Tenn Cavy. . . The disability for which his original pension was granted has greatly increased since his last medical examination. The disease has extended to both legs and both hips. He has also very severe pains in right side of head, left hip, lower part of back and left knee & heel. The Fistula for which he originally claimed pension but has received none is troubling him at times and periodically greatly disables him. That he is now totally disabled for the performance of manual labor by reason of said diseases and believes himself entitled to full pension. . . his post office address is Nonaburg, McMinn County, Tennessee. On this ___ day of ___ 1881 before me a Justice of the Peace in and for the County and State above-named, persoanlly appeared [left blank] aged 38 years, who being duly sworn according to law declares that his residence and post office address is Madisonville in the state of Tennessee and that he is the identical Pendleton Isbell who was a private of company AD@ commanded by Capt William _ Milligan in the 3d Regiment of Tenn Mt Volunteer Infty. That he volunteered at Loudon Tenn on or about the 25th day of July 1864 for the term of 100 days and was honorably discharged at Knoxville Tenn on or about the 30th day of November 1864 by reason of expiration of term of service. . . . That said horse was his own private property; that he continued mounted upon said private horse, and continued to use him in the service until the 30th day of Nov 1864 when he was discharged as aforesaid. . . . when said horse was taken from the service by claimant . . . He now claims pay at the then legal rates for the use and risk of said private horse from the 25th day of July 1864, when he entered the service to the 30 day of November 1864 when said horse was taken from the service as aforesaid. . . Madam: In response to the personal request of Hon. L. C. Houk you are informed that your claim no. 285253 as widow of Wm. Jenkins, AC@ 3r Tenn Mtd Inf is awaiting the evidence called for by letter addressed to your attorney John C. Nelson dated April 10th 1882, to prove origin of the soldiers fatal disease, condition at discharge from the army and thereafter to date of his death with cause thereof and for better proof of marriage and of birth of the soldiers children. Relative to my claim no. ______ for Pension as the widow of Stephen C. Newberry late Pvt Co.@A@ 3d Tenn Infty I have to state that I desire to abandon the prosecution of the same for the reason that the Physician who attended said soldier in his last illness is unable to certify that his death was caused by the disease for which he was granted pension.

In view of this fact I only desire to collect the accrued pension due said soldier at date of his death, a claim for which I long ago preferred, and I respectfully ask that the evidence filed in both my said claims be used in support of the latter. Respectfully [unsigned]
